Vehicle Rental Terms and Conditions – Moto M1 SA

- Subject
These terms and conditions govern the rental of motor vehicles (motorcycles and scooters) by Moto M1 SA, Via Campagna 3, 6595 Riazzino.
By signing the rental agreement, the rider accepts these terms and conditions in full. - Authorized Rider
The vehicle may be operated exclusively by the person indicated in the rental agreement (“Rider”).
The Rider guarantees that they hold a valid driving licence suitable for the rented vehicle and undertakes to immediately notify Moto M1 SA of any changes, suspension or revocation. - Use of the Vehicle
The vehicle may be used exclusively within Swiss territory.
Any use for races, competitions, sporting activities, unauthorized off-road riding, riding lessons or any other improper use is strictly prohibited.
Any violation shall result in full legal and financial liability on the part of the Rider. - Insurance and Excess
Rental vehicles are covered by a third-party liability insurance policy.
In the event of an accident or damage, the Rider shall be liable up to a maximum excess of CHF 2,000.–, as well as for any costs not covered by insurance or subject to insurer recourse.
Any specific insurance exclusions will be communicated at the time of vehicle handover. - Security Deposit
Moto M1 SA may require a security deposit prior to handing over the vehicle.
The deposit may be retained, in whole or in part, to cover damages, insurance excess, excess mileage, missing fuel, cleaning costs, fines or any other amounts owed by the Rider.
Any remaining balance will be refunded within a reasonable period after the return and inspection of the vehicle. - Vehicle Condition
The vehicle is delivered in good working order and clean condition, unless any defects or damages are recorded in the handover report.
In the absence of written notes, the vehicle shall be deemed to have been delivered free of visible defects. - Rider’s Liability
The Rider is liable for any damage caused to the vehicle during the rental period, except where covered by insurance.
The Rider is also responsible for fines, penalties, administrative fees and proceedings arising from the use of the vehicle. - Damage Reporting
Any damage or malfunction must be reported immediately to Moto M1 SA or, at the latest, upon return of the vehicle.
Failure to report damage may result in full charging of repair costs. - Mileage Limitation
The rental may be subject to a maximum mileage limit.
Each additional kilometre will be charged at a rate ranging from CHF 0.50/km up to CHF 1.00/km, depending on the vehicle category (see price list), unless otherwise agreed in writing. - Vehicle Return
The vehicle must be returned to the agreed location, date and time, in the same condition as at delivery and with the fuel replenished.
In the event of late return, Moto M1 SA reserves the right to charge additional costs or an extra day of rental. - Termination of Rental
Moto M1 SA reserves the right to terminate the rental immediately and request the return of the vehicle in the event of a breach of these terms, improper use or any risk to safety. - Data Protection
The Rider’s personal data shall be processed exclusively for the management of the rental agreement, insurance coverage, potential claims, fines or legal obligations, in compliance with applicable Swiss data protection legislation.

Moto M1 SA shall not be liable for indirect damages, loss of time or inconvenience arising from the use of the vehicle, except in cases of wilful misconduct or gross negligence. - Governing Law and Jurisdiction
This agreement is governed by Swiss law.
Exclusive place of jurisdiction: Locarno (TI).
